Service Agreement (Terms and Conditions)

Success Groups refers to the email groups at http://Success-groups.com.

The SuccessPub Service (SuccessPub) refers to any Service offered on the SuccessPub.com and Success-Groups.com.

The SuccessPub Service is available for use only by those who agree to abide by these posting terms.

If your email address rejects or bounces back incoming email, or is otherwise invalid it is subject to being banned.

Autoresponder email addresses are not allowed to post to the SuccessPub Service or be used in any aspect of the SuccessPub Service.

Posting, submitting or any other use of any email address you are not authorized to use is strictly prohibited. SuccessPub tracks IP address with every posting and may institute legal action and or report any abuse to the proper authorities.

The SuccessPub Service may be used for lawful purposes only. Submission, transmission or storage of pornography and sex-related content and merchandising and/or any material in violation of any international, federal or any state law or regulation is expressly prohibited.

SuccessPub exercises no control whatsoever over the information and data passing through any of its facilities.

SuccessPub does NOT allow any of its members to send unsolicited e-mail 'Spam'. Any form of Electronic Spamming referencing SuccessPub, or any of the SuccessPub websites is strictly forbidden, including but not limited to unsolicited email, Bulk E-mail, or Inappropriate newsgroup posts. SuccessPub reserves the sole discretion of determining what constitutes Spam. Any of our members accused of any incident of Spam that links to the SuccessPub website will lose their website plus any commissions or membership contributions due to them. SuccessPub may at its discretion, press legal charges due to Spam.

SuccessPub allows its members to make email contact with personally referred members to encourage them to upgrade to PRO or be active resellers. However, SuccessPub strongly prohibits sending any promotional messages not directly related to SuccessPub. If you are found having being involved in such cross-solicitation, your account may be terminated with loss of any commissions and membership benefits.

By Subscribing to any email groups, you agree to receive messages from the group moderator or the other group subscribers if the group is unmoderated. You also agree to receive occasional emails from SuccessPub regarding important program updates. DO NOT submit your links if you disagree with this. All promotional messages coming from the SuccessPub servers will always have identifiable removal instructions.

You agree not to provide false or misleading information on the SuccessPub Service. This includes, but is not limited to, providing false name and or e-mail address. Any commissions due will be paid to the name on your file in our database. It is your responsibility to keep your contact details including current email and mailing address updated at all times. SuccessPub cannot be held responsible for lost commissions due to inaccurate personal details.

By using the SuccessPub Service, you also agree to abide by the following rules.

If you are dissatisfied with any aspect of the SuccessPub Service or with any of our terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the SuccessPub Service.

If you order the PRO membership and your payment is by credit card, you authorize SuccessPub to charge the credit card listed on the subscription form. The charge to your credit card is one time unless stated otherwise.

All paid Services are only offered after payment has been received in advance. Paid accounts will be terminated if any payment reversal or refund takes place.

Paying customers are entitled to 30-day money back guarantee. No refunds can be issued after 30 days after purchase. SuccessPub will only issue refunds to customers who provide their transaction number (or order ID). This is always provided when every transaction is approved. The SuccessPub member ID (username) must also be provided. Refunds cannot be issued for reasons other than dissatisfaction RESULTING FROM FAILURE OF SUCCESSPUB TO PROVIDE THE SERVICE AS DESCRIBED ON THE SUCCESSPUB WEBSITE. SuccessPub will not issue a refund after Service s has been rendered. In cases where only partial Service s may have been rendered, only the amount corresponding to the percentage of Service not yet rendered can be refunded, less any commissions that may already have been paid out to the referring Resellers (Affiliates).

Any paid SuccessPub Service may be terminated with an e-mail message. The transaction number (or order ID) and SuccessPub member ID (username) must also be provided. Termination will take effect only when the receipt of the termination request has been received and confirmed by SuccessPub at support@SuccessPub.com.

Reseller/Affiliate Agreement
I understand that all dollar amounts posted on the SuccessPub websites are potential and not actual and that SuccessPub makes no claims that its Resellers will achieve such levels of commissions. I also agree that I am an independent contractor and therefore fully responsible for determining my own business activities, and will bear full responsibility for the consequences of these actions. Further, I understand that I am not an employee or legal representative of SuccessPub, and that I will not attempt to present myself in such a way as to mislead others into believing that I am an employee or legal representative of SuccessPub. I understand and agree that I am responsible for the payment of all federal and state self-employment taxes and any other taxes that may be required under federal, state, or any regulatory or taxing authority.

I also understand and agree that SuccessPub reserves the right to alter Service prices and compensation plan without prior notice. SuccessPub reserves the right not to pay Reseller commissions to any Reseller who defaults to any of the policies stated on this agreement.

Disclaimer of Warranties, Limitation of Liabilities, Indemnification
THE SUCCESSPUB SERVICE IS DISTRIBUTED ON 'AS IS' BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.

SUCCESSPUB WILL NOT BE HELD RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE SUCCESSPUB SERVICE. IN NO EVENT SHALL SUCCESSPUB BE LIABLE FOR ANY LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICE S OR THIS AGREEMENT HOWEVER ARISING, INCLUDING NEGLIGENCE. BY USING THIS SERVICE, YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. YOU ALSO AGREE TO HOLD US AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING ATTORNEY FEES MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

SUCCESSPUB RESERVES THE RIGHT TO ACQUIRE COURT FEES, ATTORNEY FEES AND ANY OTHER FEES ALLOWED BY LAW FROM ANY INDIVIDUAL OR ENTITY WHO BRINGS FORTH A LAWSUIT AGAINST SUCCESSPUB RESULTING FROM ANY AD SUBMISSION TO THE SUCCESSPUB SERVICE. OUR LIABILITY TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO $100.
